1.Introduction

These are the official rules (the “Rules”) for the Beatport and Pioneer DJ: The Big Break Contest (the “Contest”). The Beatport website terms and conditions (https://support.beatport.com/hc/en-us/articles/215996708-Terms-and-Conditions) and Privacy Policy (https://support.beatport.com/hc/en-us/articles/200353215), as well as the terms and conditions for YouTube’s website, are incorporated herein. If a conflict exists between the website terms and conditions and these Rules, these Rules shall apply.

2.About this Contest

Pioneer DJ (“PDJ”) and Beatport, LLC (“Beatport”) (individually and collectively, the “Sponsor”) are in search of undiscovered electronic DJs ready to bring their act to a larger audience. By taking part in the Contest (thus, being a “Participant”), you agree to be bound by these Rules. The Sponsor reserves the right to disqualify any Participant who does not comply with the Rules. Internet access is required. Participants must have an account on Loopcloud.com, which is free. No purchase necessary in order to participate. Decisions of the judges are final in all matters relating to the Contest.

3.Eligibility

The Contest is open only to those Participants that are at least eighteen (18) years old. You may enter as a solo, duo, or group act. The Contest is subject to all applicable laws and regulations and is not valid in Brunei, Afghanistan, Cuba, Democratic Republic of Congo, Eritrea, Fiji, Gambia, Indonesia, Iran, Iraq, Kyrgyzstan, Libya, Micronesia, North Korea, Pakistan, Palau, Somalia, Sri Lanka, Sudan, and Syria, and anywhere else such Contests may be void by law.

In addition, the Contest is not open to: (a) employees of Beatport, PDJ, or any company offering a prize as part of the Contest, any advertising, promotion, production or publicity agency doing business with any of the above, or any of their respective parents, subsidiaries, and affiliated companies, or any member of the immediate family or individual living in the same household of such employees (whether related or not) or of anyone connected with the administration of the Contest; and, (b) any Participant currently engaged in a contractual agreement (verbal or written) which would prohibit him or her from participation or restrict Sponsor’s rights to exploit the winning track.

Sponsor may prohibit any Participant from participating in or winning the Contest if, in Sponsor’s sole discretion, Sponsor determines the Participant is attempting to undermine the legitimate operation of the Contest by (i) cheating, deceiving, or utilizing other unfair practices; (ii) violating the Rules; (iii) refusing to accept the Prize or complete the Prize obligations; or (iv) acting in any disruptive manner during, or after, the Contest. By submitting an entry, the Participant accepts the terms of these Rules and agrees to be bound by the decisions of the judges, which will be final.

4.Contest Period

Sponsors shall conduct the Contest for four consecutive months, starting in January 2021. Please review the Contest landing page for specific dates regarding each month’s contest period (“Entry Period”). All times posted are Pacific Standard Time.

Each month, eight finalists (the “Finalists”) will be selected to perform on Beatport’s Twitch channel for a live stream (date for each live stream will be posted on the contest web page – please do not enter if you are not available for the live stream date). The eight Finalists will be judged during the stream, with first, second, and third place finalists (“Winners”) announced shortly thereafter. All Finalists and Winners will also be contacted at the email address provided with submission sometime before the public announcement.

NOTE: ALL DATES ARE SUBJECT TO CHANGE AT SPONSOR’S SOLE DISCRETION. PLEASE REFER TO THE CONTEST WEBSITE FOR ALL DATE INFORMATION.

5.How to Enter

All ‘Participants” must sign up for a Beatport LINK (“LINK”) and YouTube account, if Participant does not have such accounts already. There is no cost to sign up for a YouTube account and LINK currently offers a promotional free trial. If you have already used a LINK free trial, you will need a subscription to participate. Purchase of LINK will not increase your chances of winning.

Each Participant must record (audio and video) a 20-minute electronic DJ set (not to exceed 20 minutes). The Participant must utilize Beatport LINK in the performance. Once complete, upload the video to YouTube and submit on the Contest submissions page with an unlisted link to the video (it should not be posted publicly yet). Only one Entry permitted per Participant. You must provide all requested information on the entry form, as well as agree to receive emails from the Sponsors regarding updates on the Contest and other marketing and/or promotional emails from Beatport and PDJ (you may choose to unsubscribe from any email list after entering).

A representative from Beatport will review your unlisted video and confirm the Entry. Once confirmed, you will receive a confirmation email from Beatport stating you are eligible for the Contest. At that time, each Participant must make their video publicly available on YouTube and share across your preferred social media platforms, tagging both @beatport and @pioneerDJGlobal.

All Entries must be received by the deadline specified on the Contest web page. Each Entry should be submitted only once. Sponsor is not responsible for any changes or effects caused to the Participant’s computer system as a result of a submission of an Entry. Only electronic Entries submitted via the Contest web page will be accepted.

The Finalists will each be contacted by a Contest representative at the email address provided during submission. Participant must respond within 24 hours or Sponsor reserves the right to select another Participant as a Finalist for the Contest.

Sponsors are not responsible for any Entries that are removed by YouTube due to copyright, or other, violations or takedown notices. If your video is removed, you may resubmit a new Entry, with the material in question omitted, if the submission period is still open.

6.Finalists

Each Contest will have eight (8) selected Finalists. Finalists will compete on Beatport’s Twitch channel, each with a one-hour recorded electronic DJ performance utilizing Beatport LINK. If you are not available or able to the one-hour performance, you are not eligible to participate. Likewise, if you appear on the Finalists’ livestream, you will not be eligible to participate in the Contest for any of the remaining months (this only applies to The Big Break Contest – Finalists may enter in any other Beatport or PDJ contests).

7. How Will Entries Be Judged?

Judges will be comprised of members from both Beatport and PDJ. Three Finalists will be selected as winners, with a first place, second place, and third place winner. Factors that the judges may consider include but are not limited to: technical skills, mixing technique, song selection, originality, creativity, overall performance and presence, and audience engagement during the livestream. The decision of the judges is final.

8.Limited License to Entries

Participant(s) hereby grant to Sponsor an irrevocable, fully paid, perpetual world-wide license to reproduce, edit, adapt, publish, transfer, distribute, perform, display and use any or all of the video and audio from your Entry, and the Finalist livestream, if you are selected as a Finalist.

9.Prizes

All Prizes include shipping to your location. All incidental expenses not expressly set forth in the Prize will be winner’s responsibility. No substitution, cash redemption or transfer of the Prize by the winner is permitted, but Sponsor reserves the right to substitute a prize of equal or greater value for all listed Prize items. Please be advised goods can only be delivered on a business day and cannot be delivered to a PO BOX. Should the recipient not be available to receive the goods, delivery will only be attempted twice (2), any additional requirements will be at the recipients own expense or the prize shall be forfeited.

Odds of winning depend on the number of eligible Entries received. Any taxes owed as a result of winning are the sole responsibility of the winner.

10. Release and Indemnity.

Sponsor is not responsible for any damages, taxes, or expenses that any winner might incur as a result of the Contest or receipt of any prize.

All Participants agree to release, indemnify, defend and hold harmless the Sponsor, its directors, officers, employees and representatives from all claims, losses, liabilities and demands arising out of or in connection with (i) participation in the Contest, (ii) acceptance, possession, or use of any Prize, and, (iv) any claim that Participant’s entry or Sponsor’s use, distribution or commercialization of the entry violates any copyright, intellectual property right or other proprietary right of any party.

11. Rights in Your Submissions and Likeness

Participant represents and warrants he or she has the full right, title and interest to the Entry and that he or she will comply with these Rules. By entering this Contest, Participant grants Sponsor the right to use your name and likeness in association with the Entry and any announcements referencing winner of the Contest.

12. Disputes

Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually and without resort to any form of class action, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses. Participant also hereby waives any and all rights to have damages multiplied or otherwise increased. All disputes arising out of, connected with, or relating in any way to this Contest shall be finally resolved by arbitration under the ICC (International Chamber of Commerce) Rules. There shall be one arbitrator. The legal place of arbitration shall be Los Angeles, California, United States. The language to be used in the arbitral proceedings shall be English. The governing law of the contract shall be the substantive laws of United States.

13. Acknowledgement of Email Subscriptions

By entering this Contest, Participants give their express permission to be contacted by Sponsor by email or other contact information provided on the entry form. In addition, by entering the Contest, you acknowledge that you agree to participate in emails from the identified Sponsor(s) of the Contest. You may unsubscribe from any email list at any time, including during the Contest, via the unsubscribe link on any such emails.

14. Identification of Winner

Beatport has linked up with Pioneer DJ to present a fresh monthly DJ competition that will offer DJs of all sounds the chance to win great prizes, show off their skills, and build up their fanbase on a global scale.

Called The Big Break, each month Beatport will select eight finalists to play a live set to thousands of listeners on Beatport’s Twitch Channel using Beatport LINK. From these eight finalists, Beatport and Pioneer DJ will choose three winners who’ll take home €1,000’s in prizes, including subscriptions, top-of-the-line music gear, and a featured Beatport Chart. Step 1

Record a 20-minute mix (audio & video) and upload the footage as an UNLISTED video on YouTube.

• Contestants MUST be using Beatport LINK during their set.
• Don’t have a Beatport LINK subscription? Sign up for a 30-day trial.
• LINK is fully integrated within Pioneer DJ’s rekordbox, as well as many other DJ programs.

Step 2

Upload the link to your UNLISTED YouTube video along with your name, e-mail, socials, and country on The Big Break landing page here.

We will notify you once your submitted video gets approved for meeting all proper guidelines.

Step 3

Once your submission is approved, set your YouTube video to PUBLIC and share it across your social media platforms, tagging @Beatport and @PioneerDJGlobal using the hashtag #BeatportsBigBreak.

Step 4

A panel of judges from Pioneer DJ and Beatport’s curation team will review each performance and select the top eight finalists. Each finalists will be contacted individually.

Step 5

Finalists will be asked to perform an hour-long set for the competition livestream on Beatport’s Twitch channel. This occurs on the last Friday of each month, so be sure to keep this day free in your diary in case you are chosen as a winner!”

The submission deadline for the first competition is Wednesday, February 17, 2021, at Midnight Pacific time.
